Terms & Conditions
These Terms & Conditions govern all construction, construction management, interior, renovation, and related services provided by Goldfish. By engaging our services, the client agrees to the following terms:
1. Scope of Services
Goldfish provides services including architectural coordination, construction, construction management, interior works, renovation, and allied services as agreed in writing. The scope of work shall be strictly limited to what is mentioned in the approved proposal, estimate, BOQ, or agreement.
2. Estimates & Pricing
All estimates shared by Goldfish are budgetary and indicative unless stated otherwise. Final pricing is subject to finalized drawings, specifications, quantities, site conditions, material selection, and prevailing market rates. Any additional work or changes requested by the client will be charged separately.
3. Drawings & Approvals
Execution will be carried out strictly as per approved drawings and specifications. Any changes after approval may impact cost, timeline, and quantities. Statutory approvals, permissions, and sanctions are the responsibility of the client unless explicitly agreed otherwise.
4. Payment Terms
Payments shall be made as per the agreed payment schedule. Delay in payments may result in work suspension, revision of timelines, or cost escalation. All prices are exclusive of applicable taxes unless mentioned.
5. Timeline & Execution
Project timelines are indicative and dependent on factors such as timely payments, design approvals, site readiness, availability of materials, labor conditions, weather, and unforeseen circumstances. Goldfish shall not be held responsible for delays caused by factors beyond its control.
6. Materials & Brands
Material brands and specifications mentioned are indicative unless finalized in writing. Substitutions of equivalent quality may be made in case of non-availability. Any upgrade or downgrade requested by the client shall affect the final cost.
7. Quality & Workmanship
Goldfish commits to delivering work as per industry standards and approved specifications. Minor variations due to construction tolerances shall be considered acceptable and shall not be treated as defects.
8. Client Responsibilities
The client shall provide clear access to the site, electricity, water, and storage space as required for execution. Any delays due to lack of site readiness or client decisions may impact timelines and cost.
9. Safety & Site Conditions
Goldfish follows standard safety practices; however, the company shall not be responsible for damages arising from third-party interference, unauthorized site access, or force majeure events.
10. Interior & Renovation Works
Interior and renovation works may involve dismantling or modification of existing structures. Goldfish shall not be responsible for hidden defects, structural weaknesses, or unforeseen conditions discovered during execution.
11. Warranty & Defects Liability
Warranty on materials shall be as per the respective manufacturer’s terms. Goldfish shall rectify workmanship-related issues reported within the agreed defects liability period, excluding normal wear and tear or misuse
12. Termination
Either party may terminate the agreement with written notice as per the agreed terms. Payments for work completed till the date of termination shall be settled immediately.
13. Limitation of Liability
Goldfish’s liability shall be limited to the value of the work executed under the specific agreement. The company shall not be liable for indirect, incidental, or consequential damages.
14. Dispute Resolution
Any disputes shall be resolved amicably. In case of legal proceedings, jurisdiction shall be limited to Lucknow, Uttar Pradesh.
15. Acceptance
Engaging Goldfish for any service shall be deemed as acceptance of these Terms & Conditions.
Goldfish reserves the right to modify these Terms & Conditions without prior notice.
